2. Your account

You sign in with Apple or Google. You're responsible for keeping access to that sign-in and to your device secure, and for activity that happens under your account. If you think someone else has accessed your account, contact us straight away. You can sign out of other devices from the app's settings.

3. What Finights does

Finights brings together information about your financial accounts so you can see balances, transactions, recurring bills, budgets, goals, debts, investments and net worth, and a forecast of your cash over the coming weeks.

Forecasts and projections are estimates. They're calculated from the information available to us, such as past transactions, detected recurring payments, due dates and what you enter, and they can be wrong. Income may arrive late, charges may change, and data from your institutions may be delayed, incomplete or inaccurate. Don't rely on Finights alone to decide whether you can afford something or to avoid overdrafts, fees or missed payments. Always check your balances and due dates with your financial institution.

Not advice. Finights is an information tool. We aren't a bank, a registered investment or financial adviser, a dealer, a tax adviser or a credit counsellor. Suggestions in the app, such as a way to cover a projected low balance or the order of debts, are general information based on your own data, not a recommendation to buy, sell or hold any security or financial product. Talk to a qualified professional before making financial decisions.

4. Connecting your accounts

When you connect a financial account, you sign in with your institution through a third-party data provider such as Plaid. We never see or store your banking username or password. By connecting an account, you authorise us and the data provider to access and retrieve information from that account on your behalf so we can provide Finights to you. The data provider's own terms and privacy policy also apply to your use of their service.

Our access is read-only. Finights can't initiate payments, transfers or trades. Connections can stop working when an institution changes its systems, asks you to sign in again or limits what it shares, and we can't guarantee that any particular institution, account type or piece of data will be available. You can disconnect an account at any time in the app.

5. Information you add

You can add accounts and values yourself, set budgets and goals, categorise transactions, write notes, and upload statements (for example, a credit card statement for a bank we can't connect to). You're responsible for the accuracy of what you add and upload, and for having the right to upload it. When you upload a statement, we read the figures and transactions from it and don't keep the file itself.

6. Subscriptions, trials and billing

Finights requires a paid subscription. Plans, prices and any free trial are shown in the app before you subscribe and may vary by country.

• Billing is handled by Apple. Payment is charged to your Apple account when you confirm the purchase, or when a free trial ends.
• Automatic renewal. Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel it in your Apple account settings. Deleting the app doesn't cancel a subscription.
• Free trials. If a trial is offered and you don't cancel before it ends, your subscription starts and you're charged. A trial is available once per person.
• Refunds. Purchases made through the App Store are subject to Apple's refund policies, and refund requests go to Apple.
• Price changes. If a price changes, you'll be told in advance as Apple's rules require, and the new price applies from your next renewal.

Family plan. A family plan lets the subscriber share Finights with the number of other people stated in the app. Each person has their own account and their own data. Members only see what is shared with them, such as combined totals, shared goals and shared budgets, and the subscriber can remove a member at any time. If the family subscription ends, members lose the access it provided.

If your subscription ends. You'll lose access to paid features. You can still export or delete your data. About 30 days after a subscription lapses, we disconnect your connected financial accounts at our data providers. The history already synced stays in your account unless you delete it.

7. Acceptable use

You agree not to:

• use Finights for anything unlawful, or to access accounts you aren't authorised to access;
• upload false, fraudulent or someone else's statements or information without their permission;
• interfere with, disrupt or place an unreasonable load on Finights or the services it relies on;
• try to get around security or usage limits, or access Finights by automated means other than the app and features we provide;
• copy, modify, reverse engineer or resell Finights, except where the law allows it despite this restriction; or
• use Finights to build a competing product.

8. Our intellectual property

Finights, including its software, design, text and branding, belongs to Nikklab and its licensors. We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use Finights for your own non-commercial use while you follow these terms. If you send us feedback or suggestions, we may use them without owing you anything.

9. Your data

You keep ownership of your financial information and the content you add. You give us permission to store and process it only to provide, secure and improve Finights for you, as described in our Privacy Policy. We don't sell your personal information and we don't show ads. You can export your data or delete your account from the app at any time. An export is prepared in the background, you're notified in the app when it's ready, and it can be downloaded for 24 hours.

10. Third-party services

Finights relies on services we don't control, including financial data providers, Apple and Google for sign-in, Apple for billing, and providers of market prices and exchange rates. Their availability, accuracy and terms are their own. We aren't responsible for third-party services, and a link to or integration with one isn't an endorsement.

11. Changes to Finights and ending your use

We're always improving Finights and may add, change or remove features. You can stop using Finights and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if required by law, or to protect Finights, our users or others. Where reasonable, we'll tell you first. If we stop offering Finights entirely, we'll give you notice and a chance to export your data.

12. Disclaimers

To the fullest extent the law allows, Finights is provided "as is" and "as available". We don't promise that it will be uninterrupted or error-free, or that information, forecasts, balances, prices or valuations shown in it will be accurate, complete or current. Some jurisdictions don't allow certain warranties to be excluded, so some of this may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

13. Limitation of liability

To the fullest extent the law allows, Nikklab and its directors, employees and service providers won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost savings, overdraft or late fees, or loss of data, arising from your use of Finights or your reliance on information in it. Our total liability for any claim relating to Finights is limited to the greater of the amount you paid for Finights in the 12 months before the claim arose and CAD $100. These limits don't apply where the law doesn't allow them.

14. Indemnity

If you use Finights in breach of these terms or the law, and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.

15. Apple App Store

If you downloaded Finights from Apple's App Store:

• These terms are between you and Nikklab, not Apple, and Nikklab, not Apple, is responsible for Finights and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store's usage rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
• Nikklab, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone else's intellectual property.
• You confirm that you aren't located in a country subject to a Canadian or U.S. government embargo, and aren't on any government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Before starting a formal dispute, please contact us so we can try to resolve it. Any dispute that can't be resolved informally will be heard by the courts of Ontario, unless the consumer protection laws where you live give you the right to bring it elsewhere.

17. Changes to these terms

We may update these terms from time to time. If a change is material, we'll tell you in the app before it takes effect. If you keep using Finights after the change takes effect, the updated terms apply. If you don't agree, you can stop using Finights and delete your account.

18. General

These terms and our Privacy Policy are the whole agreement between you and us about Finights. If a part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't waived it. You can't transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
